Charges Dropped Against Baker and Bowman

I guess this is good news.

BELLEFONTE -- Felony aggravated assault charges were dismissed against Penn State University football players Chris Baker and Navorro Bowman today in Centre County Court.

Both players were bound over for trial on the misdemeanor counts of simple assault and disorderly conduct and summary counts of harassment and stalking.

The charges were filed after a fight that occurred on campus on Oct. 7.

No date was set for trial.

The district attorney's office plans to look into refiling the felony charge against the two.

Wait, so chargers were dropped by the court, but the DA is considering refiling charges? I knew a bunch of people who got into fights all the time in college, and I can't recall any of them facing felony charges for it. Let alone having felony charges dropped and refiled by the DA. It sure seems to me the people in the DA's office have it out for Penn State football players.

No word yet on what this means for Baker and Bowman's status for the bowl game.

Ridiculous
This was just more bad press for the Penn State football team that perhaps was undeserved.  Yes, football players are privelaged.  Yes, they have the responsibility to stay out of these types of situations.  But can we get a running total of the number of charges brought against Penn State players in the last couple of years, and the number of those charges that have been dropped?

Baker & Bowman Out
There is no way these guys should be making the trip to San Antonio, regardless of what happens with this case - especially Baker (2 time loser).  

The last thing we need is trouble down by the Riverwalk, to sully the off season.  

This isn't a game that anyone on the team will likely care about winning.  It's evident they didn't care about beating Michigan State, why should they care about beating some mediocre Big 12 team?  

The coaches need to set the tone for 2008 and leave the clowns at home until they learn to act like Penn State football players and not like thugs.

Mike, where there's tons of smoke, there's some fire. Not every case, for sure, but the more smoke, the more fire.

You want to ignore this and let their acts bring shame, go ahead, but don't pretend you're being smart by doing so. If anything, the football players have substantial legal advantages that regular students don't have.

Were there is news, there are idiots...
Read the comments by the judge in this case, go to www.centredaily.com and read the news story. The judge gave the district attorney's office a tounge lashing for rushing to judgement, and shakey legal claims.

I think Mike shares the same opinion as a local judge, would you mind going on the record and calling a judge someone pretending to be smart?

What do you work for the DA's office or something?

Where there is smoke there is fire?  Here is some smoke for you; how about having in excess of thirty charges over the course of a year dropped by a Judge without trial. That means he decided  that what the D.A.'s accusations do not even meet the legal elements of a crime?   Look up prima facia on the internet. That's not smoke, but rather definitive proof of shitty lawyering and a hick DA deciding he wants to get his face on TV so he charges college kids with crimes he has no hope of proving in Court.  That is unethical, plain and simple.  No delusion about it.

As for advantages the players have that others don't.  What advantage is that, a lawyer?  The University didn't hire Johnny Cochran for them, Joseph Amendola and Karen Muir are local attorneys that anybody can hire.

The alternative is that he is a crappy DA that doesn't know the law.  Carmine Presita used to be Chief of Police in State College.  He is not exactly a cop hater.

The facts are what they are, every single player that has been charged with a crime this year, including Austin Scott, has had the most serious charges against them dismissed at a Preliminary Hearing.

It is either overreaching or stupidity, you pick which one, and I'll go with it.

It's possible that what you're seeing are judges who give football players the benefit of the doubt beyond that which they'd give a random student. Couple that with some difficult prosecutions (melees, with or without football players, are very difficult to convict) and you've got a recipe for exactly what we've seen here.

It's also possible the players were all innocent little lambs and that a bunch of small-town yokels are out to get them. But do you really believe that? Really? After the posse-gathering apartment beatdown (which nobody is disputing happened, remember, just which players did exactly what - meaning the defense attorneys are doing their jobs well).

State College Justice
First of all, not Judges, Judge.  Carmine Prestia is the Magistrate Judge for Downtown State College and campus.  He has had that job for about ten years, prior to that he was the Chief of Police.  I have testified in his courtroom, and he is a good judge, very fair and even handed, especially when giving students the benefit of the doubt.  He was a good cop too, and I don't say that very often at all.  He ran SCPD in 1994, remember the Michigan game when downtown was flooded with students and there were no arrests or serious incidents of violence to report, rather than the 1999 Tom King tear gas the students after the Miami game debacle.   The difference between the two days was 100% Police Tactics.

Second, State College may be a small media market, but these stories have all been picked up nationally by both Sports Illustrated and ESPN and they are being reported in every newspaper in the state, I have not checked the Pittsburgh Post-Gazette today, but the fact that these charges were dropped will definitely be printed by tomorrow.

Next, I don't recall ever saying the players were innocent little lambs, or even innocent.  I think they got into a fight, and I don't know (and you don't know) who started it, why, or what really happened. To blindly assume guilt is just as foolish as to blindly assume innocence, although the latter is the presumption afforded to the accused in a crime.

What I am doing lambasting a professional attorney (again not yokels, yokel, singular), who has taken an oath to be impartial and fair, who repeatedly charges people with crimes that he can't prove.  I find that conduct distasteful, and I would argue vehemently against with respect to any person, regardless of whether or not they played football for Penn State.

Bottom line here...
is that some folks who want to be influential towards the program (ala boosters) are trying to spin this out as the program is totally out of control, and then use that to nail JoePa to the wall and force him into retirement. Bottom line is this, LET THE JUDICIAL SYSTEM CARRY ITSELF OUT!!!! Do that BEFORE you accuse the coaches, BEFORE you claim we are living our lives with our head in the sand. Just because some of us believe in justice doesn't mean we refuse to admit MAYBE the players are wrong. Rather some of us aren't joining the lynch mob gathering outside of Lasch, and those of you in that mob who are armed with your degree, and alumni awards, and checkbooks want throw Joe underthe bus as soon as possible.

Great post jesse, this guy needs someone to stand up to his onesided point of view.

Seriously, what the hell is wrong with you guys? Are prosecutors only supposed to make charges when they're 100.000% sure they can win a conviction? Does RUTS know this?

The guys above have written thoughtful, insightful posts regarding the judge and DA, and all you can EVER reply with is "the sky is falling!!"

NO ONE condones what some of these kids ALLEGEDLY did...where are any of us saying that?  However, if they are found to be guilty of nothing more than bad judgement, why continue to harp on it?

You're the only one here who sees parallels between PSU and Thug U (Miami), so maybe it's time to stop acting like your opinions are more righteous than everyone else's and step down off your high horse.  It's getting old.

College athletes getting into fights
wow, what a shocker. I agree that the apt. fight was incredibly stupid, as well as the HUB incident. But to think that these kind of things are new to Penn State, well then I would have to question your "my family is more Blue & White then all ya'lls statement". Didn't they tell you that back in the day when players were caught doing stupid shit the cops would bring them to Joe's house and he would make them sleep at his house, then run the hell out of them the next day? Because the times have changed and news now reaches us almost immediately, we hear/read every time a player is involved in a fight. Just keep that in mind.

Ignoring Nothing
Hold on now. I think I've made my position plenty clear in the past. These kids were idiots that night by getting in a fight. I was glad they didn't make the trip to East Lansing. I think my exact words were "kick them off the team."

The commentary above dealt with the DA, who I feel is being overly cruel to these kids. Some kids got into a shoving match at the Hub. One guy, who many witnesses say started the whole thing, got a bloody nose. Is that worth felony charges? And after the judge throws out the felony charges the DA says they are going to consider refiling them? Doesn't that seem like a waste of the court's time? It seems to me the DA has it in for the football players. Maybe the local television stations of Centre County seem like small potatoes to you, but getting his face on those crappy channels is what gets him re-elected. And the football players seem too dumb to stay out of trouble and give him bait to chew on.

You are absolutely right, Mike,
about the DA being overly cruel with the kids.  Regarding both the April apartment melee and the October fight, a friend of mine who works in State College with the student body says that these things happen every single weekend, but when football players are involved, the DA seems to like getting his name in the paper and his face on TV  and makes a bigger deal out of it than he would with regular students.  Maybe some good Philadelphia lawyer needs to think about filing harassment charges against the DA.

Baker WILL NOT BE ATTENDING
According to the Centre Daily Times of State College, monday Baker was informed by the office of Judicial Affairs he has been expelled from school for one year. His attorney said they will appeal the charges.

Also, according to the report, there were several witnesses who flat out said that the alledged victim in this attack actually started it! In which case the charges will likely be dropped by all parties.

This thing is far from over, but as for now Baker will NOT be attending the bowl game.
