Prosecutorial Misconduct

This DA has now gone after two football players with dubious facts for rape/sexual assualt. Does everyone remember the Scott Paxson situation? Now we have a situation with Austin Scott where the accusor had a history of false accusation and apparantly was on top of Scott! Couple those accusations with the DA not pursing charges against any of the students involved in pushing Scirotto's girlfriend to the ground and sucker punching AS (they all received summary offenses) while pursuing felony charges against several players involved in the aftermath including Justin King (whom by ALL reports was acting as a peacemaker) PLUS charging Baker for the HUB incident which he was obviously not apart of (or PSU would have kicked him out of school) and you have get a sleezy DA who needs to be reinged in! In the latest round of incidents involving PSU players the same DA has had two indictments thrown out by Judges when seeking charges. What does he do....refile charges and accuse the Court of being biased. One of the articles about Scott indicated that he may sue the Commonwealth due to the actions of the DA. I for one hope he does. This joker in Centre County is just as bad as Mike Nifong was in the Duke incident. He continuely ignores important facts and evidence to serve his own agenda of securing national headlines! I hope the PSU community that was so quick to condem Scott (including JoePA)will support him if he chooses to undertake such an endeavor.

I will support him. This case ruined his college football career and possibly any NFL career he could've had.

But I still don't think he was performing as well as Kinlaw or Royster...even though I think he could've been as good as say....Tony Hunt. Boy I miss that guy.

I'll send a check

to Austin Scott's legal team if they sue the DA. The worst thing is that false allegations like this make it harder for women who actually are assaulted. Does anyone know if the accuser be charged with anything, like false swearing?

No Charges

The DA maintains that charging Scott was proper despite KNOWING that the accusor had a sorted past. This DA is all about winning and does not want to lose. He folded his case when the Court ruled that the prior act of the accusor was admissable. IF the DA truly believed the women's case he should have pressed forward with his case despite the ruling of the Court. Instead he folded...because he knew he had no case.

Scott never lived up to the high school hype...but he was in JoePA's doghouse the whole time he was at PSU. Despite the fumbles he had this year, he does have the size and ability to play RB in the NFL or CFL. His employment opportunities are severely impacted by this incident and as someone else referred to in Mike's column......the 'evidence' in the case should have been on the cover of every sports page in the nation....but it wasn't. Only the negative publicity makes the headlines. The facts of this will not come out on a national level unless someone goes after the DA. I find it intersting that the PA Bar has not investigated the Centre County DA at this point. There have to be some high powered alums that can raise some hell about this j/o!

Let be sane here. Scott's college career was a disaster before any charges. While it may have taken him off of the field, at least he was off the field leaving all of the turnovers for Morelli.

Now, back to the DA. I wish he would just go away! He sucks, and makes false charges all of the time.

Well said, Pic15...

How long must crap like this go on before someone does something about it? It's really getting ridiculous. I'm with you in really hoping Scott sues the Commonwealth. Finally, some people in power would be forced to take a hard look at this guy (Michael T. Madeira). Assuming they're reasonable people, I'm pretty sure they'd be as disgusted with his behavior as we are.

Back to the Austin Scott case. It's obvious that Madeira had fully dedicated himself to ruining Austin's life regardless of what the evidence said. The guy had no case against Austin whatsoever. None. Why? Because Austin didn't do anything wrong! That was the truth, but the truth didn't matter to Madeira.

As Mike noted in his recent post, Madeira made it very clear what kind of man he is in his statement to the press: "It is with DEEP REGRET that we... withdraw the charges against Austin Scott". Translation: I deeply regret having to set an innocent man free when I could have sent him to prison for life and padded my resume with a rape conviction. That's the definition of human garbage if you ask me.

Of course, some people might disagree with me, but I'm sticking to my guns on this one.
