Andrew Quarless Charged With DUI

Well, put us on the board in the Fulmer Cup. Andrew Quarless was arrested for DUI early Sunday morning.

Penn State tight end Andrew Quarless was charged Thursday with DUI after State College police say he was stopped early Sunday while driving with a blood alcohol level of .084 percent.

Quarless, 19, of Uniondale, N.Y., was stopped at 2:54 a.m. Sunday at the intersection of East College Avenue and South Pugh Street when police said he ran a red light in a white BMW, according to the criminal complaint filed Thursday at the office of District Judge Jonathan Grine.

"Did I go through the red light?" police say Quarless asked the officer.

The complaint said the officer smelled a moderate odor of alcohol on Quarless and that the tight end failed field sobriety tests.

A blood test taken about a half hour later showed Quarless had a .084 BAC, the complaint states.

Quarless is charged with DUI, DUI as a minor, failing to obey traffic control signals and underage drinking.

I'm not exactly up on my Fulmer Cup scoring system. At most that's two points per charge for a total of eight points. Doesn't it seem like double jeopardy to charge him with DUI, underage drinking, and DUI as a minor? Shouldn't a DUI be a DUI? And isn't underage drinking underage drinking? Why make up this DUI as a minor charge? Is anyone ever going to get charged for DUI as a minor and not get charged for DUI and underage drinking? I love our legal system.

And what's the legal limit in PA now? I believe it's 0.06. So he was basically 0.024 above the legal limit. That's like a third of a can of beer. He couldn't stand on one foot and touch his nose? Weird. If you remember, in his first underage drinking incident I believe his BAC was below 0.1 as well after he said he had "just a few glasses of wine".

Does anyone else find the white BMW interesting? I'd be interested in seeing this thing. Is it a beat up 1995 model or are we talking a $50,000 vehicle?

UPDATE: FOS reports on the incident. Interesting tidbit about the white BMW.

The criminal complaint said Quarless was driving a white BMW when he was pulled over. Multiple sources have told FOS that the car did not belong to him, but rather a friend he was with late Saturday night.

This does not sound good to me. Maybe it's nothing. Who knows.

oh quarless...
a failed sobriety test could mean anything.  the cop knew he had him, and it was all over from then on.

driving after any drinks in state college is stupid.  everybody knows it.  especially if you're not 21!  they are really good at catching people.  quarless will be punished amply by all this, i'm not going to say anything about what i think SHOULD happen to him.  i HOPE he can get his act together for 2009 (maybe).

the ego involved to drive intoxicated (albeit mildly), underage, in a BMW, at 3 am, in state college, is infuriating.

What's the point of driving when you can walk anywhere AND even find a random cab once in a while.  That's why I went to PSU in the first place - couldn't afford a car and didn't  need one.  The idiocy of this team continues to amaze me.  Hell if he was drunk, he could have called JayPa and he'd have picked him up.  Jay did it plenty of times for guys when he was "on" the team.

Stupid to Drive but.....
No doubt this was another bonehead decision by Quarless.   But let's not say he was drunk.  .84 is about 3 beers.  DUI laws while important have gone overboard.  Depending on what state you live in, it has gotten to the point where 2-3 social drinks can land you in the slammer, cost you your license, job and whateverelse.  Not a good start to spring ball!
I thought only safeties played 15 yards off the ball?

The limit is .08 if your 21, zero tolerance if your not.

So, he's DUI under the regular standard, Drinking anything and driving as a minor is a crime no matter the limit (had he been .04, he would only have been charged with DUI as a minor), the underage drinking and the initial moving violation.

Free legal advice; the answer to the question, "have you been drinking?" is always "No."  Not I had a glass of wine with dinner (Why is it always wine? Like the cop gives a shit, "Oh just wine, then have a nice night my fellow sophisticate").  The second you admit to you've been drinking, you're nailed, you've just done the cops job for him.  They love that. Two glasses of wine and you'll fail a breathalyzer, but the cop's not clairvoyant, if you r not obviously drunk he's not going to haul you out of the car unless you give up probable cause, which the admission you've been drinking does.

If you get stopped and you've been drinking;
1] DO, have you insurance and registration ready to hand to the cop and only roll the window down a crack to hand it to the cop.
2] DON'T, ask why you got pulled over. Who gives a shit? Pay whatever ticket you have to in order to avoid the DUI.
3] DON'T, engage the cop in any un-necessary conversation.  Keep your answers short, and don't argue with him.  See #2. Eat the ticket and move on. Q: Do you know why I pulled you over? A: No, sir. If he tells you, say yes sir.  The cop wants you to start slurring your words and raving like an asshole.  Just keep your cool, and keep your mouth shut.
4] DO, tell everybody in your car to shut the hell up too.

plan you have there, but I just don't even drive after drinking, not even 1 beer(which I always go for a good) lol. I've had my license suspended a few times before and its really not worth it. Also the fact that lives could be in danger when you try to drink and drive, but I must say I like your style lol.

Here is a question for you.  Is BAC used so as to be fair ?  By fair I mean as an effort to remove subjectivity from the equation ?  I am quite certain that at various points in my life I could have blown .15 and still given the cop the 2nd derivative of a function had I been asked.  I don't think that is fair.  Likewise, but wife could probably have a BAC of .05 and not be able to spell her name.  Is my logic flawed ?

Fair? I don't know.  It certainly takes the subjectivity out of it, and makes the process of arrest, conviction and processing pretty much ministerial.

Your point about different tolerances is what makes my "plan" work, to the extent it does. You don't seem drunk; and if your driving is not obviously impaired without the admission, the cop lacks probable cause to search you (the search is field sobriety test).

At the end of the day 95% of people who are charged with DUI admitted to the cop they were drinking when they got stopped, and their chance of getting away with it ended right there.  The other 5% were passed out behind the wheel.  

Obviously, your best bet is not to drink and drive, but if you find yourself in a pickle (and a guy in my line of work can't be too judgmental) take some advice and hope you get lucky.

I think it is different
there have been many times where I have done my homework drunk at PSU mainly b/c I forgot about it and then realized it needed to be done

I beleive that cognative (sp) capacity and logical thinking are affected differently than motor skill when alcohol is involved

just from my personal experience anyway

still a dumbass for doing it underage, what a waste of talent, maybe if Mor(on)elli threw him the ball more he would realize how good he could have been

You handed control over to them when you got behind the wheel (I'm also scared to death of a single beer if I'm DD, so I just stick to teatotaling), now keep your mouth shut, do what they say, and pray to god she gives you a pass on your inexcusable stupidity.

Actually all the cop needs is reasonable artibuable suspicion that you are DUI to haul you in.  Even if Quarless denied drinking....if the cop smells "the ordor of an alcoholic beverage on his breath"....coupled with the fact that he ran a red light.  He has such suspicion and can very easily haul him in for DUI.  Especially in f*n State College.....the only f*n D-1A college town in the country where the po-po and the dickhead DA have it out for the football team.  On to another subject.....if it comes out that the DA had evidence which showed that Chris Baker was not involved in the HUB incident as determined by judicial affairs....his ass should be before the State Bar for prosecutorial misconduct!  This f'er is just as bad as Nifong!

I speculate it was a female cop, he said 'can I tell you who I am?,' then proceeded to solicit her sexually. When she shot him down, he said 'wait, I can give you Phil Taylor,' she thought about it, remembered Baker & the CC DA already fingered him, and turned him down and brought him in....

jaypa and pryor
were passed out in the back seat.  Pryor was going to commit after a great night on the town but when it came to the question of who supplied the alcohol Jaypa and Chris Bell (happened to be in the police station for another "incident") blamed Pryor.  Pryor's dad then beat Terelle, Jaypa, and Bell into pulps.

I guess I was fortunate
I didn't have a car when I was at Penn State.  I would have probably blown a .15 on many a Saturday night.

Not that there was or is anywhere to park it on a Saturday night.  

Living in front of the 'Gaff and around the corner from the Skeller helped.

I had a car
And was smart enough not to drive drunk.  I have been through extensive schooling and training since my PSU days and have now been working for 15 years.  At every step of my education and employment I was asked about criminal background and all included specifically DUI.  I did get underage drinking at 19yo, but if you drive drunk you will wreck your career as Quarless is showing us, if not your some innocent person's life.

I've never had a DUI either and that's true, that question has come up every time I've interviewed.  Not something you want to answer "yes" to.  

Cab fares will never add up to what you'll pay for a DUI.

I've told cops
I had a couple of beers with dinner when pulled over, because I figured it'd be worse to lie, because if you have even one beer it's on your breath.  The one time I made an illegal right on red, and I said that, and I didn't get a DUI.  To get a DUI if you're below the legal limit, I think you have to display a great deal of impairment.  But Quarless was over .08 anyway, so it doesn't matter.  It's so frustrating to see how these kids don't seem to realize what a fantastic opportunity they have as scholarship athletes at Penn State.
