Andrew Quarless Charged With DUI
Well, put us on the board in the Fulmer Cup. Andrew Quarless was arrested for DUI early Sunday morning.

Quarless, 19, of Uniondale, N.Y., was stopped at 2:54 a.m. Sunday at the intersection of East College Avenue and South Pugh Street when police said he ran a red light in a white BMW, according to the criminal complaint filed Thursday at the office of District Judge Jonathan Grine.
"Did I go through the red light?" police say Quarless asked the officer.
The complaint said the officer smelled a moderate odor of alcohol on Quarless and that the tight end failed field sobriety tests.
A blood test taken about a half hour later showed Quarless had a .084 BAC, the complaint states.
Quarless is charged with DUI, DUI as a minor, failing to obey traffic control signals and underage drinking.
I'm not exactly up on my Fulmer Cup scoring system. At most that's two points per charge for a total of eight points. Doesn't it seem like double jeopardy to charge him with DUI, underage drinking, and DUI as a minor? Shouldn't a DUI be a DUI? And isn't underage drinking underage drinking? Why make up this DUI as a minor charge? Is anyone ever going to get charged for DUI as a minor and not get charged for DUI and underage drinking? I love our legal system.
And what's the legal limit in PA now? I believe it's 0.06. So he was basically 0.024 above the legal limit. That's like a third of a can of beer. He couldn't stand on one foot and touch his nose? Weird. If you remember, in his first underage drinking incident I believe his BAC was below 0.1 as well after he said he had "just a few glasses of wine".
Does anyone else find the white BMW interesting? I'd be interested in seeing this thing. Is it a beat up 1995 model or are we talking a $50,000 vehicle?

This does not sound good to me. Maybe it's nothing. Who knows.

oh quarless...
driving after any drinks in state college is stupid. everybody knows it. especially if you're not 21! they are really good at catching people. quarless will be punished amply by all this, i'm not going to say anything about what i think SHOULD happen to him. i HOPE he can get his act together for 2009 (maybe).
the ego involved to drive intoxicated (albeit mildly), underage, in a BMW, at 3 am, in state college, is infuriating.

So, he's DUI under the regular standard, Drinking anything and driving as a minor is a crime no matter the limit (had he been .04, he would only have been charged with DUI as a minor), the underage drinking and the initial moving violation.
Free legal advice; the answer to the question, "have you been drinking?" is always "No." Not I had a glass of wine with dinner (Why is it always wine? Like the cop gives a shit, "Oh just wine, then have a nice night my fellow sophisticate"). The second you admit to you've been drinking, you're nailed, you've just done the cops job for him. They love that. Two glasses of wine and you'll fail a breathalyzer, but the cop's not clairvoyant, if you r not obviously drunk he's not going to haul you out of the car unless you give up probable cause, which the admission you've been drinking does.
If you get stopped and you've been drinking;
1] DO, have you insurance and registration ready to hand to the cop and only roll the window down a crack to hand it to the cop.
2] DON'T, ask why you got pulled over. Who gives a shit? Pay whatever ticket you have to in order to avoid the DUI.
3] DON'T, engage the cop in any un-necessary conversation. Keep your answers short, and don't argue with him. See #2. Eat the ticket and move on. Q: Do you know why I pulled you over? A: No, sir. If he tells you, say yes sir. The cop wants you to start slurring your words and raving like an asshole. Just keep your cool, and keep your mouth shut.
4] DO, tell everybody in your car to shut the hell up too.

Here is a question for you. Is BAC used so as to be fair ? By fair I mean as an effort to remove subjectivity from the equation ? I am quite certain that at various points in my life I could have blown .15 and still given the cop the 2nd derivative of a function had I been asked. I don't think that is fair. Likewise, but wife could probably have a BAC of .05 and not be able to spell her name. Is my logic flawed ?

Your point about different tolerances is what makes my "plan" work, to the extent it does. You don't seem drunk; and if your driving is not obviously impaired without the admission, the cop lacks probable cause to search you (the search is field sobriety test).
At the end of the day 95% of people who are charged with DUI admitted to the cop they were drinking when they got stopped, and their chance of getting away with it ended right there. The other 5% were passed out behind the wheel.
Obviously, your best bet is not to drink and drive, but if you find yourself in a pickle (and a guy in my line of work can't be too judgmental) take some advice and hope you get lucky.

I think it is different
I beleive that cognative (sp) capacity and logical thinking are affected differently than motor skill when alcohol is involved
just from my personal experience anyway
still a dumbass for doing it underage, what a waste of talent, maybe if Mor(on)elli threw him the ball more he would realize how good he could have been
